Rules and Regulations

1. Contest will begin on June 15, 2009, and end on September 25, 2009.

2. Scratch & Win cards will be given away at participating full-service Trustmark Bank branches. Florida market Trustmark branches are excluded.

3. Scratch & Win cards will be available only while supplies last.

4. Open any new Trustmark personal or business checking account in a participating branch, and you will receive a Scratch & Win card. No purchase necessary to play. To request a Scratch & Win card by mail, send a 3 x 5 card with name, complete address and daytime phone number to Trustmark Bank Sandestin Giveaway, ATTN: Sales Management, P.O. Box 291, Jackson, MS 39205. Requests must be received by September 25, 2009. All mail-in requests must be hand printed, mailed separately and bear sufficient postage. Only one Scratch & Win card is available per household.

5. Participants must be at least 25 years of age to be eligible to win.

6. Employees (and their immediate family members) of Sandestin Golf and Beach Resort and Trustmark Bank are ineligible to participate in this promotion.

7. Five (5) of the 5-Night prize packages will be awarded. Ten (10) of the 3-Night prize packages will be awarded. All prizes will be randomly awarded on distribution scratch-off cards.

8. One (1) additional 3-Night Package will be rewarded as part of the Refer-A-Friend promotion. Customer must complete referral form with referring customer’s name, address, phone number and email address and submit to a Trustmark Financial Services Representative. Referral forms will be entered into a drawing and one (1) winner will be drawn at random.
  

9. Five Nights Free prize package will consist of 6 days/5 nights of luxurious accommodations for four in a two-bedroom condominium at The Village of Baytowne Wharf, with breakfast or lunch for four at Another Broken Egg, four passes to Dunes Putting Course, two beach chair set ups for three days and four rounds of golf at one of Sandestin’s four championship golf courses. Total estimated value of prize package: $3,000.

10. Three Nights Free prize package will consist of 4 days/3 nights of luxurious accommodations for two in a standard room at Sandestin’s Bayside Inn, with breakfast or lunch for two at Another Broken Egg.

11. One Night Free prize will require winner to book three nights at winner’s choice of accommodation to receive the fourth night free. Includes any accommodations on the Sandestin property. Winner will also receive a Sandestin Sandollar Savings Coupon Book upon check-in at the resort.

12. Five-night and three-night prize package certificates must be claimed by October 30, 2009, or prizes will be forfeited.

13. For five-night and three-night prize packages, winners must book trip within one year of date prize is received, or prizes will be forfeited. For fourth night free with the booking of three nights, trip must be booked before December 30, 2009.

14. Trips must be booked at least 21 days prior to arrival. Trips subject to availability and blackout dates; blackout dates include but are not limited to July 2-5, 2009; September 4-7, 2009; November 26-29, 2009; December 31, 2009; May 28-31, 2010; July 2-5, 2010; September 3-6, 2010. Neither Sandestin nor Trustmark Bank will provide travel, meals, transportation or incidentals aside from what is listed in the prize packages. Prize packages do not include tax or gratuities.

15. Sandestin Golf and Beach Resort and Trustmark Bank management reserve the right to change, modify or cancel the contest at any time.

16. Entries generated by script, macro or other automated means will be void. Sandestin Golf and Beach Resort and Trustmark Bank are not responsible for misdirected, incomplete, lost, late, illegible, undelivered, inaccurate or delayed entries or for technical, hardware or software failures of any kind; lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person’s ability to participate in the Contest, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes or in any Contest-related materials. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond Sandestin Golf and Beach Resort’s control, which corrupt the integrity, administration, security or proper operation of the Contest, Sandestin Golf and Beach Resort or Trustmark Bank reserves the right, in its sole discretion, to modify, cancel or suspend the Contest. In the event of cancellation, Sandestin Golf and Beach Resort reserves the right to award prizes from among all eligible, non-suspect entries received prior to the event requiring such cancellation. False or deceptive entries or acts will render the entrant ineligible.

17. Winners may each be required to execute an affidavit of eligibility, liability release, tax acknowledgment form and, except where prohibited by law, a publicity release and return within five (5) business days of issuance of notification. Noncompliance within this time period or failure of potential winner to respond after three (3) notification attempts may result in disqualification and, at Sponsor’s discretion, an alternate winner may be selected. If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize, (iii) a potential Winner fails to comply with any of the Official Rules as outlined herein, such potential Winner will be disqualified and an alternate winner will be selected by random drawing.

18. Sandestin Golf and Beach Resort and Trustmark Bank expressly disclaim any responsibility, and entrants agree to indemnify and hold harmless Sandestin Golf and Beach Resort and Trustmark Bank, their affiliates, agents and officers from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the prizes awarded (including any travel or activity related thereto).
